In order to become a member and a participant of yatt'it, Hyatt's Online Community ("yatt'it"), you must be a Hyatt Gold Passport member. You will use your Hyatt Gold Passport username and password to sign into yattit.com. If you are signing-in to yattit.com for the first time, you will need to set up a yatt'it Profile and indicate your agreement to these terms and conditions ("Terms"). It is your responsibility to ensure the information (including any images) set out in your yatt'it Profile complies with these Terms. You must choose a yatt'it profile name (which is separate from your Gold Passport username). Please keep the name appropriate. For your own protection and validity reasons you agree to never give your password out to another person, except a yatt'it administrator. You are responsible for the security of your password and will be solely liable for any use or unauthorized use under such password. You also agree to NEVER use another person's account for any reason. We also HIGHLY recommend you use a complex and unique password for your account, to prevent account theft. By participating in yatt'it, you agree to all of the rules governing your use as provided in these Terms. Hyatt may revise these Terms from time to time. If you continue to participate in yatt'it after we post changes to the Terms, you accept and agree to be bound by the revised terms and conditions.
You may use yatt'it solely for personal and non-commercial purposes only and subject to these Terms, all applicable laws, rules and regulations and any agreements or terms with third parties to which you are subject. You may not use spiders, robots, data mining techniques or other automated devices or programs to catalog, download or otherwise reproduce, store or distribute content available on yatt'it. Further, you may not use any such automated means to manipulate yatt'it or attempt to exceed the limited authorization and access granted to you under these Terms. You may not resell use of, or access to, yatt'it to any third party.
In order to ensure compliance with the Children's Online Privacy Protection Act of 1998 (COPPA), yatt'it does not accept membership registrations from users who are under 13 years of age. By registering with yatt'it, you represent that you are at least 13 years old.
Posted Materials
The information and opinions expressed on yatt'it are those of its respective contributors only and do not represent the views of Hyatt Corporation, its subsidiaries, affiliates and management ("Hyatt"). Hyatt makes no representations or warranties regarding such posted materials and does not warrant the accuracy, completeness or usefulness of any information presented. Participants should be aware that yatt'it is a public online community, not private communications. When you voluntarily disclose personal information on yatt'it, that information can be collected and used by others and may result in unsolicited messages from other people. You shall not submit, upload or post to yatt'it any content which:
(1) Libels, defames, invades privacy, or is obscene, pornographic, abusive, or threatening;
(2) Infringes any intellectual property or other right of any person or entity, including but not limited to, violating anyone's copyrights or trademarks;
(3) Falsifies or deletes author attributions, legal notices or other proprietary designations;
(4) violates any law;
(5) Advocates illegal activity;
(6) Knowingly contains viruses, corrupted files, or other materials that may cause damage to another's computer, or
(7) Advertises or otherwise solicits funds or sales of goods or services.
Categories of prohibited content above are merely examples and are not intended to be exhaustive. Hyatt will make the sole determination as to whether or not content is acceptable for yatt'it.
By posting any content on yatt'it, you agree to indemnify Hyatt, all other yatt'it participants, and any other person or entity affiliated with yatt'it, from and against any and all third party claims, demands, liabilities, costs or expenses, including reasonable attorneys' fees, resulting from your breach of these posting restrictions, your use of yatt'it (except to the extent caused by a negligent act of Hyatt), your content, your violation of these Terms or your violation of applicable law.
Unless materials are specifically restricted as noted in the content, by posting any content authored or owned by you on yatt'it, you automatically (a) grant to all other yatt'it participants, and any other person or entity affiliated with yatt'it, a perpetual, royalty-free, irrevocable and unrestricted worldwide right and license to use, reproduce, and distribute the posted content for the limited purposes of discussion and commentary, (b) grant to Hyatt a perpetual, royalty-free, irrevocable and unrestricted worldwide right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from and distribute the posted content or incorporate the posted content into any form, medium, or technology now known or later developed, for any and all purposes, including but not limited to advertising and marketing, without payment or compensation to you and without seeking any further approval from you; and (c) waive all "moral rights" with respect to the posted content.
yatt'it Posting Rules
yattit.com is a Hyatt online travel community. All postings should be relevant to travel related topics, categories and destinations, or in the best interest of the yattit.com community.
Please refrain from submitting and posting irrelevant, unconstructive and inappropriate tips and comments. This site is not intended to be used for addressing concerns or issues pertaining to Hyatt or Hyatt Gold Passport.
By posting content to yattit.com, you agree to adhere to the Posting Rules, which apply to all submitted and posted content, including tips, comments and uploaded images. yattit.com reserves the right to enforce these rules.
In addition, please note that yattit.com reserves the right to remove any content deemed inappropriate for the yattit.com site. Site users also reserve the right to report offensive content to yattit.com.

Termination
In addition to any right or remedy that may be available to us under these Terms or applicable law, we may suspend, limit or terminate your account, or all or a portion of your access to yatt'it, at any time with or without notice and with or without cause.
Compliance With Intellectual Property and Defamation Laws
Hyatt or its licensors are the exclusive owners of all copy, software, graphics, designs and all copyrights, trademarks and other intellectual property or proprietary rights contained on or used in connection with yatt'it. Except as set forth herein, you agree not to copy, distribute, modify or make derivative works of any materials without the prior written consent of the owner of such materials. All rights not granted under these Terms are reserved by Hyatt.
Hyatt cannot advise yatt'it participants with respect to compliance with intellectual property and other laws. However, we ask you to be aware of the following -- it is a commonly held but very mistaken belief that materials posted on the Internet are automatically in the public domain. This is not correct. Except for official government documents, virtually all works of original authorship are protected by copyright regardless of the manner of publication or distribution, including online. Except under very limited circumstances constituting "fair use," you must get the copyright owner's permission before reproducing all or part of a copyrighted work.
It is the sole responsibility of each yatt'it participant to ensure that the materials she or he posts to yatt'it do not infringe or violate the intellectual property rights, publicity, privacy or other legal rights of others. Your postings will not be reviewed, screened or approved for such violations by Hyatt.
The Hyatt complies with the provisions of the Digital Millennium Copyright Act of 1998, 17 U.S.C. Sec. 512. Pursuant to that Act, Hyatt will promptly remove posted materials in the event a copyright owner provides proper notification to us alleging that the posted materials constitute copyright infringement. If your postings are removed under this procedure, we will notify you and provide the opportunity for response as provided under the Act.
It is our policy not to permit materials known by us to infringe another party's copyright to remain on yatt'it. If you believe any materials on yatt'it infringe a copyright, you should provide us with written notice that at a minimum contains:
(i) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
(ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
(iv) Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted;
(v) A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
(vi) A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Limitations on the Hyatt's Liability
yatt'it is maintained and operated solely for informational purposes. Your participation in yatt'it is at your own risk. The posted materials could include misinformation, technical inaccuracies or other errors. They are provided to you "as is" without warranty of any kind, either express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose. Hyatt does not warrant that the functioning of yatt'it will be uninterrupted or error-free, that defects will be corrected, or that yatt'it or the server that makes it available are free of viruses or other harmful components. Hyatt does not warrant or make any representations regarding the use or the results of the use of the materials on yatt'it in terms of their correctness, accuracy, reliability, or otherwise.
Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to you. Under no circumstances, including, but not limited to, negligence, shall Hyatt be liable for any special, indirect, incidental or consequential damages that result from the use of, or inability to use, the materials on yatt'it, even if Hyatt or a Hyatt-authorized representative has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of certain damages, so the above limitation may not apply to you. General Provisions
Hyatt does not warrant or represent that yatt'it participation is appropriate or available in locations outside the United States and Canada. If you choose to participate from other locations, you do so at your own initiative and you are responsible for complying with local laws, if and to the extent local laws are applicable. You may not download or otherwise export or re-export software from yatt'it in violation of United States export controls.
Hyatt moderates yatt'it and reserves the right to: (1) remove objectionable content (including links and images) from any part of yatt'it, within a reasonable time frame and without notice, if it determines that removal is necessary to comply with these Terms, applicable law or for any other reason in Hyatt's sole discretion. While every attempt is made to remove objectionable material as quickly as possible, reviewing every post is a manual process it may be impossible to remove or edit particular messages immediately; (2) exercise editorial control over posted content. By submitting a comment to any Blog or Forum, you understand and agree that we may post your comment in its entirety, in an edited version, or not at all. Any editing will be done primarily for purposes of clarity, length or deletion of offensive, inappropriate, or potentially defamatory material; (3) Hyatt may delete, move or close any Forum, Blog, topic or comment at any time at its absolute discretion; (4) reveal your identity (or any other related information collected on yatt'it) in the event of a formal complaint or legal action arising from any situation caused by your use of yatt'it; (5) include information about, and links to, other Hyatt content and information that may be of interest to you.
These terms shall be governed by and construed according to the laws of the state of Illinois, as they are applied to agreements entered into and to be performed entirely within Illinois. Any claim or cause of action arising out of or relating to these terms shall be barred unless such claim or cause of action is brought within one year after it arises; any such claim or cause of action shall be brought only in the state or federal courts in the Northern District of Illinois, and you consent to jurisdiction of such courts for the purpose of litigating such actions. Whenever possible, each provision of these terms shall be interpreted in such manner as to be effective and valid under applicable law, but if any provision is deemed prohibited or invalid under applicable law, such provision shall be ineffective to the extent of such prohibition or invalidity without invalidating the remainder of such provision or the remaining provisions of these terms.
